PROCLAMATION NO. 239/2001
A PROCLAMATION TO AMEND THE
ANTI-CORRUPTION SPECIAL PROCEDURE AND
RULES OF EVIDENCE PROCLAMATION
WHEREAS, it has be come necessary to amend the Anti-Corruption Special Procedure and Rules of Evidence Proclamation;
NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:
1. Short Title
This Proclamation may be cited as the “Anti-Corruption Special Procedure and Rules of Evidence (Amendment) Proclamation No. 239/2001”.
The following new Article 51 is included in Section Seven of the Anti-Corruption Special Procedure and Rules of Evidence Proclamation No. 236/2001, and the Previous Articles 51,52 and 53 are renumbered as Articles 52,53 and 54 respectively.
“51. Investigation and Bail
1) Any application for arrest, search, remand, restraining or any other similar application or issue related to investigation of corruption offences shall be heard by the court which has a jurisdiction to hear cases of corruption offences.
2) A person who is arrested on suspicion of having committed a corruption offences shall not be released on bail.”
3. Effective Date
This Proclamation shall come into force as of the 12th day of June, 2001.
